  Mumbai attack mastermind Tahawwur Rana has been brought to India from the US. He will now be tried here as the mastermind of the November 26, 2008 terror attack in Mumbai. 166 people were killed in the attack. If the laws of India and the US are considered, Tahawwur Rana can be sentenced to death. To determine whether Tahawwur Rana will be given the death penalty or not, it will have to be seen what the law of the country from which he is being extradited says and what the law of the country to which he is being brought provides for the punishment for the crime of which he is guilty. What do the experts say? On the issue of Tahawurr Rana being sentenced to death for his crime, Supreme Court lawyer Gyanant Singh says that in the case of extradition, if the country from which the accused is coming has death penalty, then he can be given death sentence here in India as well. On Rana being a Canadian citizen, he says that it does not matter which country the accused is a citizen of, if the crime is committed in India then it will be dealt with as per Indian law. Indian law will apply to it. "In the case of extradition, the country from which the accused is brought can impose conditions, but if the crime is punishable with death penalty in that country, it generally does not impose a condition of not imposing the death penalty. Anyway, extradition is a judicial process, it is ordered by the court and the laws and extradition treaties of both the countries are considered. If we look at Indian law, the punishment for a criminal involved in terrorist activities ranges from life imprisonment to death penalty and in the Mumbai attack case, the accused Pakistani national Ajmal Kasab was hanged. But Tahawurr Rana's case is slightly different from Kasab. Rana is being extradited from the US to India. In such a situation, he will be tried and sentenced as per the conditions of extradition."
