'You are responsible for the rape', Allahabad High Court grants bail to the accused; said - the victim herself invited trouble

  The Allahabad High Court granted bail to the accused in the rape of a student, observing that ‘the girl herself had invited trouble and she is responsible for the alleged incident.’ In this case, the victim says that she met the accused Nischal Chandak in a bar in Delhi’s Hauz Khas and was raped in an inebriated state. The accused says that the sexual intercourse was consensual.

The case was registered under Section 64 of the Indian Penal Code at Police Station No. 126, Gautam Budh Nagar. The accused was arrested on December 11, 2024. The victim, who was studying in a university in Noida, had gone to a bar in Delhi with three friends. He says that he met some acquaintances there, including the accused.

Raped in an inebriated state - Victim
After drinking alcohol, he was in an inebriated state and the accused was approaching him. He stayed in the bar till 3 am, repeatedly asking her to go with him. According to the victim, due to the accused's repeated requests, she went with him to "relax".

The accused had taken the victim to his flat
The bail plea said that the victim needed help and she herself agreed to go with him. It is also alleged that the accused was touching the victim inappropriately on the way and instead of taking her to his house in Noida, he took her to his relative's flat in Gurgaon and committed the crime there.

Victim invited trouble - High Court
The victim was staying in a PG hostel. The court of Justice Sanjay Kumar Singh said, 'If the allegations of the victim are accepted as true, it can also be concluded that she herself invited trouble and is also responsible for it.' The doctor did not mention sexual violence during the medical examination.
