  Child Kidnapping Cases: A Public Interest Litigation (PIL) has been filed in the Supreme Court seeking a country-wide uniform procedure for investigation of child abduction and kidnapping cases, including time-bound investigation and speedy trial. The petition, filed by advocate Ashwini Kumar Upadhyay, has sought the Centre and states to prepare standard questionnaires and special investigation procedures for such cases. It has also been demanded that the investigation should not be conducted by an officer below the rank of ACP or SHO and that dedicated courts be set up on the lines of special courts for MPs and MLAs so that child abduction cases can be disposed of within a year. The petition further seeks confiscation of movable and immovable properties of the accused and their family members and enforcement of laws related to money laundering, benami property and black money. It also seeks that the sentences for kidnapping be made consecutive instead of concurrent so as to create an atmosphere of fear. The petition alleges that the delay in lodging FIRs and investigation of complaints related to missing children hinders their recovery and exposes them to the risk of trafficking, sexual exploitation, forced labour and illegal adoption. It is also alleged that complaints related to missing children are sometimes registered as mere “missing” or “missing” reports instead of FIRs, delaying full criminal investigation.
