Delhi Protest Row: Plea filed in Supreme Court against suspension of rail and metro services in Delhi; action sought against officials

  A plea has been filed in the Supreme Court regarding the complete suspension of metro and rail services during the CJP protest in Delhi. The petition seeks contempt of court proceedings against the officials responsible for violating court orders.

The application, filed by Advocate Shailendra Mani Tripathi, names Union Home Secretary Govind Mohan, Delhi Police Commissioner Anurag Kumar, and Delhi Metro Rail Corporation Chairperson D. Thara as respondents. The application, filed through Advocate Chand Qureshi, states, "This brutal assault on the fundamental rights of citizens and the disregard for this Court's orders constitute a calculated, deliberate attempt by the Delhi Metro, Delhi Police, and the Central Government, which must be dealt with sternly."

The petition cites the apex court's order dated October 9, which was passed during the hearing of a separate petition challenging the closure of 57 metro stations and the cancellation of trains bound for Delhi in view of the protest.

The call for the protest has been issued by the 'Cockroach Janata Party' (CJP) and certain student organizations against Chief Election Commissioner Gyanesh Kumar over alleged irregularities in the functioning of the Election Commission.

While hearing the petition on Friday, Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice V. The bench led by Justice Mohana had directed the Centre to ensure there was no "complete halt" to the movement of metro trains and other trains entering Delhi on October 10 due to the protests, stating that everything could not be brought to a standstill.

The apex court had observed that while law enforcement agencies have the authority to take measures to restrict unnecessary traffic, citizens should not be subjected to undue harassment.

The contempt petition states that despite the solemn judicial order and the assurances given to the apex court, the authorities "deliberately maintained a complete blockade of transit corridors, continued to cancel trains without justification, and failed to issue or disseminate transparent traffic and transit advisories." The application urges the apex court to issue notices to the respondents, directing them to appear in person and show cause as to why they should not be punished for contempt of court.

An advisory states that the Delhi Metro has closed 45 stations from 9 PM on Friday until 6 PM on Saturday due to security reasons. PTI.
