'Judiciary cannot enter everywhere', Supreme Court refuses to hear petition related to Kargil war

  The Supreme Court has refused to hear a petition related to the 1999 Kargil war. A former army officer had filed a public interest litigation (PIL) alleging that there was some negligence on the part of the army during the 1999 Kargil war. While hearing this petition, the Supreme Court said that there are some things in which the judiciary should not interfere. The Supreme Court said that this is a matter related to the executive. Therefore, it was refused to hear it.

We cannot enter everywhere
A bench of Chief Justice Sanjiv Khanna and Justice Sanjay Kumar heard the matter and said, "The judiciary does not generally hear matters related to national security. Whatever happened during the Kargil war in 1999 is a matter related to the executive."

It is worth mentioning that former army officer Manish Bhatnagar had filed a petition alleging that he had confirmed the infiltration of the Pakistani army in Kargil even before it was officially reported.

Hearing the petition, Chief Justice Sanjiv Khanna said, "There are some things in which the judiciary should not interfere and if we do so, it will be wrong". The bench told the former army officer, 'You participated in the war and now the issues should be left as they are'. After this hearing, Manish Bhatnagar sought withdrawal of his petition, which the court allowed him.

What allegations did the former army officer make
Manish Bhatnagar, a former officer of the 5th Battalion of the Parachute Regiment, in his petition had raised questions about the confirmation of the infiltration of the Pakistani army and the subsequent conduct of the army operation. Bhatnagar had alleged that he had informed senior army officers about the infiltration in January-February 1999 itself, but his information was ignored.

Along with this, the former army officer also alleged that when the full-scale war broke out, he was court-martialed on some other pretext and forced to leave the army.

When did the Kargil War take place
It is worth mentioning that the Kargil War lasted from May to July in 1999 and during this the Pakistani army intruded. However, the Indian army gave a befitting reply and the Pakistani army faced defeat.
