RG Kar Case: Why was the rape convict not hanged? Judge Anirban revealed everything in a 172-page report

  RG Kar Case: Additional District and Sessions Judge Anirban Das of the Sealdah court has given the reasons in his 172-page copy of the judgment why the crime of cruelty to a female doctor does not fall under the category of rare, in which the accused can be given the death penalty. In fact, in the case of rape and murder of a trainee female doctor at the Government RG Kar Medical College and Hospital in Kolkata, Judge Das on Monday sentenced the accused civic volunteer Sanjay Rai to life imprisonment (till death).

Why was the convict not hanged?

Justice Das cited the historic judgment of the Supreme Court in the 1980 Bachchan Singh vs. Punjab Government case as the reason for not awarding the death penalty to the convict. He said that there are some guidelines of the Supreme Court regarding the death penalty in this case. The incidents of RG tax cannot be compared with the strict criteria laid down in that directive for imposing the death penalty. Therefore, this crime cannot be called a rare incident.

When is the death penalty awarded?
Justice Das said that a crime will be considered rarer than rare when there is no question about it. Judge Das believes that death penalty should be awarded only when there is no scope for improvement. Judge Das said in his direction that there is a lot of scope for improvement in this case.

Judge Das said in his decision that he has listened to the statements of all the parties very seriously. Along with this, the post-mortem report, photographs taken during the post-mortem and the opinion of the forensic doctors of RG Kar were also considered.

What are the things mentioned in the decision?
The judge said that several injury marks were found on the victim's body. Judge Das said that after listening to all the parties and considering the evidence, I believe that the incident of rape and murder was carried out by the same person. He has also mentioned the brutality of this incident in his decision. He also cited the shortcomings of the police and hospital management in his judgment, where rules were violated.

No one else was present at the incident
Justice Das's directions also rejected the claim that another woman was present during the incident. The judge said that due to negligence during the post-mortem, DNA of another woman was found on the body of the deceased in normal quantities. The saliva found on the victim's body matched Sanjay's DNA 100 percent.
